Tinnitus covered by accident insurance

If you have insurance against accidents you may be covered if you get tinnitus. A tinnitus claim was supported by a German court.

A judge in the German Oberlandesgericht in Koblenz ordered an insurance company to pay compensation to a man suffering from tinnitus. The man suffered from tinnitus caused by the explosion of a tractor tire he was pumping air into.

The insurance company argued that tinnitus has psychological causes and thus was not covered by the insurance.

Outcome overturned

A lower court at the Landgericht in Koblenz sided with the insurance company. But the judge at the higher court at the Oberlandesgericht found differently and ruled in favour of the claimant.

The insurance company must now pay compensation to the claimant who suffered Acoustic Trauma as well as tinnitus because of the explosion.
